Welcome to MusicBoost Grants! These Terms of Service ("Terms") govern your access to and use of the MusicBoost Grants website (the "Website") and our grant application services (collectively, the "Service"). Please read these Terms carefully before using the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. Eligibility
To apply for a grant, you must be an independent musician or band not currently signed to a major record label, be at least 18 years old, and meet any other specific eligibility criteria outlined for the particular grant program. You represent and warrant that you meet all eligibility requirements.
2. Grant Applications
Submitting an application does not guarantee that you will receive a grant. Grant recipients are selected based on criteria determined by MusicBoost Grants and its review panel, including but not limited to musical quality, artistic vision, project feasibility, and potential impact.
2.1 Application Fees
The Platinum Grant program requires a non-refundable application fee as stated on the Website. This fee helps cover administrative and review costs associated with the evaluation process by our panel. Payment of the fee does not constitute entry into a sweepstakes, lottery, or game of chance, nor does it influence the selection process or guarantee a grant award. Failure to win a grant after paying an application fee does not entitle the applicant to a refund.
2.2 Submission Content and Originality
You represent and warrant that all information and materials submitted in your application, including music files, links, biographical information, and project descriptions, are accurate, truthful, and are your own original work or work that you have the legal right and authority to submit for consideration. You may not submit applications or materials on behalf of other artists without their express written consent and authorization. Submitting plagiarized work or work belonging to others without permission is strictly prohibited and will result in immediate disqualification.
2.3 Grant Award Amounts
Stated grant award amounts (e.g., "up to $2,000" for Platinum Grants) represent the maximum potential funding for the Platinum grant type. MusicBoost Grants is a for-profit entity, and the actual amount awarded to any selected recipient is determined at the sole discretion of MusicBoost Grants. Factors influencing the final awarded amount may include, but are not limited to, the number of applications received during a specific period, the quality of the applicant pool, overall program funding availability, and specific project needs outlined in the application. MusicBoost Grants reserves the right to award amounts less than the stated maximum or, in certain circumstances, potentially more, based on these factors. **All grant awards are determined based on the merit of the application as assessed by the review panel against the program criteria.**
2.4 Annual Grand Prize
Eligibility for the Annual Grand Prize is limited to Platinum Grant applicants as described on the Website. **Selection for the Annual Grand Prize is made from the pool of monthly Platinum Grant winners based on the demonstrated merit, impact, and achievement during their grant period and is not determined by chance.** The awarding of the Annual Grand Prize is contingent upon the continued operation of the MusicBoost Grant Program by its managing entity and the availability of funds designated for the prize at the time of award determination. MusicBoost Grants reserves the right to modify, suspend, or cancel the Annual Grand Prize promotion based on operational status or funding availability, with notice provided on the Website where feasible.
2.5 AI-Created Music
Music created solely or partially with the assistance of artificial intelligence (AI) tools is permitted for submission, provided that you, the applicant, hold all necessary legal rights, licenses, and permissions required to submit the music for grant consideration and potential promotional use by MusicBoost Grants as outlined in these Terms. You are responsible for ensuring your AI-assisted submissions comply with all applicable laws and third-party terms of service related to the AI tools used.
2.6 Verification of Legitimacy
MusicBoost Grants reserves the right to request additional information or documentation to verify the legitimacy, originality, and ownership of any submitted music or application materials. This may include proof of identity, evidence of rights ownership, or clarification of creative processes (including the use of AI tools). Failure to provide requested information in a timely manner may result in the disqualification of your application.
3. Intellectual Property
You retain all ownership rights to the music and content you submit in your application. However, by submitting an application, you grant MusicBoost Grants a limited, non-exclusive, royalty-free, worldwide license to use, reproduce, display, and distribute the submitted materials (including artist name, song excerpts, images, and biographical information) solely for the purposes of evaluating your application and for promotional activities related to the MusicBoost Grants program (e.g., showcasing winners or finalists on our Website or social media). This license terminates if your application is not selected, except for archival purposes or as required by law.
4. User Conduct
You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Service. Prohibited activities include, but are not limited to, submitting false information, infringing on intellectual property rights, attempting to gain unauthorized access to the Service, and using the Service in connection with any activities prohibited by our payment processors, including but not limited to illegal gambling, lotteries, or sweepstakes. Submitting plagiarized work or work belonging to others without permission is strictly prohibited and will result in immediate disqualification.
5. Disclaimers
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. MusicBoost Grants makes no warranties, express or implied, regarding the operation of the Service or the information, content, or materials included therein. You expressly agree that your use of the Service is at your sole risk.
MusicBoost Grants does not warrant that the Service will be uninterrupted or error-free, and we will not be liable for any interruptions or errors.
6. Limitation of Liability
In no event shall MusicBoost Grants, its directors, employees, or agents, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
7. Indemnification
You agree to defend, indemnify and hold harmless MusicBoost Grants and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
